Achieving the Right Child Custody and Visitation Solution for You

Courts in California generally prefer joint custody solutions whenever possible. In this arrangement, the parents share important decisions regarding the child’s education, medical care, religious upbringing and other matters. Typically, the child lives primarily with one parent while the other is granted visitation rights.

In every case however, the court will decide in favor of “the best interest of the child.” This means that many other types of child custody and visitation solutions are possible.

Negotiation or Litigation?

If the parents can come to an agreement about custody and the child’s living arrangements, the court will usually agree. At my practice, my first choice in custody and visitation matters is a negotiated settlement that protects my client’s rights and is in the best interest of the child. A negotiated settlement is also less emotionally stressful than litigation, and can enable the child to adapt more easily to his or her new situation.

Entering into litigation is more risky, because the outcome is less predictable. But if that is the best option, I will aggressively litigate to protect your rights and achieve your goals.
